Reduction Program Registration

The following application is intended for those who are NOT eligible for OR do NOT wish to participate in the Traffic Diversion Program. If your ticket carries zero points, do not apply, as there is no further reduction that can be given. Once you have applied for a reduction and receive your offer letter, you will no longer be eligible to apply for the Traffic Diversion Program on this matter.

*PLEASE NOTE* If you received a ticket for 1144-(A) or 1144-A(A) it is ineligible for both the Traffic Diversion Program and the Reduction Program. Please contact the appropriate court to proceed with the resolution of your citation.

Please be aware that fines, surcharges and points will be assessed with the Traffic Reduction Program. All fines, surcharges and points are set by the Court and by NYS regulations, not the DA’s office.

You should consider applying for the Traffic Diversion Program first as the outcome, if eligible, results in a dismissal of your charges with no points and no fines assessed.

It is your responsibility to contact the Court (listed on the bottom of your ticket) to let them know that you are applying for a reduction and request an adjournment of your court date.

Properly submitted applications will receive a response, by mail, within 30 days.

To proceed, you MUST provide electronic copies of the following items. You will have the opportunity to upload each of them. PDF format is requested to avoid delays.

• A clear copy of your TICKET(s). Tickets must be legible and not submitted upside down or they will be rejected! (If you need to obtain a clear copy of your ticket, reach out to the Court)
• A current copy of your driving record (ABSTRACT). This is not your driver’s license. A NYS resident's driving abstract may be purchased online by clicking here. Out-of-state and Canadian drivers must provide their driving record from their home state or country. Our office will accept non-certified abstracts, with a minimum of 18 months of driving history.
• Driver’s license- you will be required to enter your ID# from your license. (This will not need to be uploaded)

IF AND ONLY IF there was a vehicle accident ...

• You must provide a copy of the Accident Report (MV-104a). You may obtain your accident report from the police agency.
• Our office will need a letter from your insurance company stating all property/personal injury damages have been paid in full.

After your application has successfully been submitted, it will be forwarded to an Assistant District Attorney to review. You will receive a letter within 30 days. If you were found eligible for a reduction and you agree to that reduction, you will need to sign, date and mail the letter back to the COURT. DO NOT return the letter to the District Attorney’s Office. If you reject the proposal, you need to advise the Court, and they will inform you of your trial date.

Any questions about fines, penalties, and adjournments should be addressed with the Court.

• All plea proposals are final. Do NOT contact the District Attorney’s office for a better offer.
• You have the right to have your violation addressed through the court system.
• If you choose to go to court, you or your attorney have the right to discovery of records involved as well.
• You have the right to have your violation reviewed by a judge. You also have the right to have an attorney represent you and the court may determine that you are eligible for a free attorney if you cannot afford one.
